Participation terms for Nexus Sailing events
Version 1.0 • Effective from 15 June 2026
At Nexus Sailing, we believe the best sailing experiences are built on trust, shared responsibility, and open communication. These Terms of Participation are designed to help everyone enjoy a safe, respectful, and memorable time together on board.
Please take a moment to read them before joining one of our sailing events.
1. General Provisions
1.1. These Terms of Participation govern participation in sailing events organised by Nexus Sailing, represented by Paweł Kowalczyk (“we”, “us”, “our”).
1.2. A Participant is any person taking part in a sailing event organised by Nexus Sailing.
1.3. These Terms are accepted by checking the appropriate box in the booking form, making a booking, or paying either the booking fee or the full participation fee.
2. Nature of the Sailing Event
2.1. Our events are recreational, sailing, or themed experiences taking place aboard a yacht under the command of the Skipper.
2.2. Participants acknowledge that sailing takes place in changing weather and sea conditions and involves an element of adventure.
2.3. The itinerary, planned route, destinations, and additional activities are provided for guidance only and may change.
2.4. The Skipper may change the route, schedule, or overnight location whenever necessary for the safety of those on board, due to weather, technical issues, decisions of local authorities, or other circumstances beyond our control.
3. Booking and Event Confirmation
3.1. Submitting a booking request does not automatically confirm that the sailing event will take place.
3.2. A place is reserved once the booking fee for the selected event has been received.
3.3. An event is considered confirmed once we send written confirmation by email, messaging app, or another agreed communication channel.
3.4. Some events require a minimum number of Participants to go ahead.
3.5. Any flights, ferries, or other transport booked before the event is confirmed are arranged entirely at the Participant’s own risk.
3.6. We are happy to share travel advice or help Participants coordinate transport where possible. However, Nexus Sailing is not a party to any agreements relating to flights, ferries, or other transport services.
4. Payments and Cancellations
4.1. Payment terms for each event are provided in the booking confirmation.
4.2. Participants may cancel their booking at any time before the event has been confirmed.
4.3. Once the event has been confirmed, the booking fee becomes non-refundable.
4.4. If a Participant cancels after confirmation, we may refund part or all of the amount paid if the place is filled by another Participant.
4.5. If necessary, we reserve the right to replace the yacht with another of a comparable standard due to circumstances beyond our control.
5. Participant Responsibilities
5.1. Participants agree to follow the Skipper’s instructions relating to safety.
5.2. Participants agree to use the yacht and its equipment responsibly and only for their intended purpose.
5.3. Participants are responsible for any damage caused by themselves, as well as by any person or animal under their care. This also includes damage resulting from failure to follow the Skipper’s instructions, safety procedures, or onboard rules.
5.4. If responsibility for damage cannot reasonably be established and it occurred during a shared activity, the cost of repair may be shared among the Participants involved.
5.5. Participants are expected to treat fellow Participants, the Skipper, and the yacht with respect.
5.6. The Skipper may refuse participation in specific activities or remove a Participant from the event if their behaviour poses a risk to the safety of people on board or the yacht itself.
6. Alcohol and Drugs
6.1. Alcohol must not be consumed while sailing, during manoeuvres, or while carrying out tasks related to operating the yacht.
6.2. The Skipper may restrict or prohibit alcohol consumption on board at any time.
6.3. The Skipper may refuse a Participant’s involvement in manoeuvres, operating the dinghy, or other activities if they believe the Participant’s condition could compromise safety.
6.4. Participants remain fully responsible for the consequences of any actions taken while under the influence of alcohol or drugs.
7. Health and Safety
7.1. Participants confirm that their health allows them to safely take part in a sailing event.
7.2. Before the event begins, Participants agree to inform the Skipper of any medical conditions, allergies, physical limitations, or other circumstances that could affect their own safety or that of others on board.
7.3. Participants acknowledge that access to medical assistance may be limited or delayed while at sea.
8. Shared Onboard Budget (APA / Boat Kitty)
8.1. Depending on the type of sailing event, Participants may contribute to a shared onboard budget (the “Boat Kitty”), sometimes also referred to as APA on certain charters.
8.2. The Boat Kitty is used to cover shared onboard expenses, including groceries, marina fees, fuel, water, provisions, and other costs agreed upon by the Participants.
8.3. The Skipper and any professional crew members are not expected to contribute to the Boat Kitty.
8.4. Participants agree to provide meals for the Skipper throughout the sailing event.
8.5. Management of the Boat Kitty may be entrusted to one of the Participants.
8.6. The Boat Kitty is a long-standing sailing tradition that helps keep shared expenses simple, transparent, and fair for everyone on board.
9. Additional Activities
9.1. Additional workshops, sports, artistic, social, or recreational activities may be organised during the event.
9.2. Participation in these activities is entirely voluntary.
9.3. We do not guarantee that every activity presented in promotional materials will take place.
10. Photos and Media
10.1. Consent for the use of photographs or other recordings featuring a Participant is entirely voluntary.
10.2. Declining such consent does not affect the ability to participate in the event.
11. Final Provisions
11.1. We may update these Terms of Participation from time to time.
11.2. The latest version will always be available on the Nexus Sailing website.
11.3. These Terms are governed by the laws of Poland.
